Legal · Privacy policy
Your privacy, in plain English.
What we collect when you visit this site, join our email list or become a member, why we collect it, and the choices you have.

The short version
- We collect only what we need: your email if you ask for the free checklist, basic site usage data, and your membership details from Whop when you join.
- Whop handles checkout and payment. We never see your full card number.
- We use cookies to understand how the site is used and, once it is switched on, the Meta Pixel to measure our ads. You can opt out.
- We don't sell your personal information for money. You can ask to see, correct or delete your data at any time.
Who we are
This policy covers marksfxacademy.com and our email list. Both are run by MarksFX Academy, the trading education business founded by Mark Bechara ("MarksFX Academy", "we", "us"). We decide how the personal information collected here is used, which makes us its "controller" under laws such as the EU and UK General Data Protection Regulation (GDPR).
This policy does not cover Whop, Telegram, Zoom, TikTok or other services we link to. They have their own privacy policies, and we explain below how we work with them.
What we collect
| Information | When | Why |
|---|---|---|
| Your email address, and your first name if you give it | When you request the free Gold Pre-Market Checklist or join our email list | To send the checklist and the emails you signed up for |
| Your messages and the contact details in them | When you email us or message us through Whop | To reply and help you |
| Device and usage data: pages viewed, links clicked, browser and device type, the site that referred you, and your IP address and approximate location | When you browse this site, through server logs, cookies and similar tools | To keep the site working and secure, see what is useful and measure our ads |
| Membership details: your name, email, Whop username, the product you bought, and your membership status and dates | When you join a membership or book a session on Whop, which shares these with us | To give you access, support you and manage your membership |
| Affiliate details: your Whop username and referral activity | If you join our affiliate program on Whop | To track referrals and run members' programs |
We don't ask for government ID numbers, and we don't need sensitive information such as health details. Please don't send it to us.
How we use it
- To deliver the checklist and send the emails you asked for, including lessons, live session updates and information about our memberships. You can unsubscribe at any time.
- To provide your membership and support you as a member.
- To answer your questions.
- To understand how the site is used, fix problems and improve it.
- To measure our ads and show them to people likely to be interested, including people who have visited this site, once the Meta Pixel is switched on.
- To keep the site and community secure and prevent fraud and abuse.
- To meet legal, tax and accounting duties and enforce our Terms of Use.
We don't use your information to make automated decisions that have legal or similarly significant effects on you.
Our legal bases (EU and UK visitors)
- Consent: for our email list, and for analytics and advertising cookies including the Meta Pixel. You can withdraw consent at any time.
- Contract: to give you access to a membership or session you bought.
- Legitimate interests: to run, secure and improve the site, answer your messages and keep basic records. We weigh these interests against your rights.
- Legal obligation: to keep the records the law requires.
Our email list
When you request the checklist, we add your email address to our list. Our email service provider stores it and sends emails for us. Like most email tools, it can record whether an email was opened and which links were clicked, so we can tell which lessons are useful.
Every email has an unsubscribe link. After you unsubscribe, we keep your address only on a "do not email" list so we don't contact you again. We never sell or rent our email list.
Cookies, analytics and the Meta Pixel
Cookies are small files a website stores in your browser. Pixels and local storage work in a similar way. This is what this site uses, or may use:
| Tool | What it does | Type |
|---|---|---|
| Hosting provider | Delivers the site and keeps short-term server logs, including IP addresses, for security and troubleshooting. It also stores checklist signups (your name and email) until we move them to our email service. No cookies. | Essential |
| Google Fonts | Loads our fonts from Google's servers, so Google receives your IP address and browser details. Google says the Fonts service does not set cookies. | Essential |
| Site analytics | Counts visits and shows which pages and links are used, so we can improve the site. | Analytics |
| Google Ads tag | Tells Google when someone who clicked one of our Google ads requests the checklist or clicks to join, so we can see which ads work. Google may use this data under Google's own privacy policy. You can manage ad personalization at adssettings.google.com. | Advertising |
| Meta Pixel | Tells Meta (Facebook and Instagram) when someone who saw our ads visits the site or takes an action, such as requesting the checklist or clicking to join. It also lets us show ads to past visitors. Meta may link this to information it already has about you, under Meta's own privacy policy. | Advertising |
Where the law requires it, for example for visitors in the EU and UK, we will ask for your consent before setting analytics or advertising cookies. When you click through to join, you leave this site for whop.com, which uses its own cookies under Whop's policy.
Your choices
- Block or delete cookies in your browser settings. This site works fine without them.
- Control how Meta uses your activity for ads in your Meta ad preferences.
- Opt out of interest-based ads from many ad companies at optout.aboutads.info, or at youronlinechoices.eu in Europe.
- Turn off image loading in your email app to stop email open tracking.
Browsers' "Do Not Track" setting has no agreed standard, so this site does not respond to it. You can still use the choices above.
Payments through Whop
Our memberships and 1-on-1 sessions are sold on Whop. When you buy, Whop collects and processes your payment and billing details under its own Terms of Service and Privacy Policy. We never receive or store your full card number.
Whop shares with us the details we need to run your membership, listed in the table above. Billing, renewals and cancellations are managed in your Whop account.
Community platforms
Gold VIP and our other memberships run on Whop and also use other platforms, including Telegram for alerts and Zoom for live classes. When you use these platforms, their privacy policies apply too.
- Anything you post in the community chat, on Telegram or in a Zoom class can be seen by other members.
- Live classes are recorded for the members' recordings vault. If you turn on your camera or microphone, or post in the chat during a class, that may appear in the recording.
- The community includes an AI support bot. Questions you send it are processed by the bot's service provider to generate answers, so don't include sensitive personal details.
When we share information
We don't sell your personal information for money. We share it only in these cases:
- Service providers who help us run the business, such as our hosting provider, email service provider, analytics and advertising tools, Whop and the community platforms. They may use it only to provide their services, or as their own policies describe.
- Meta, through the Meta Pixel once it is switched on, to measure and target our ads. Under some U.S. state laws this can count as "sharing" or "targeted advertising". See your rights below.
- Legal reasons, when the law requires it or when it is needed to protect our rights, our members or the public, for example to respond to a valid legal request or prevent fraud.
- Business changes, if MarksFX Academy is sold, merged or reorganized. The new owner must honor this policy.
- With your permission, for anything else.
How long we keep it
- Email list: until you unsubscribe. After that, only a "do not email" record.
- Messages: as long as we need them to help you and keep a record of the conversation.
- Membership and affiliate records: while you are a member or affiliate, and afterwards for as long as tax, accounting and legal rules require.
- Analytics and advertising data: for the period set in each tool, which we keep as short as practical.
When we no longer need information, we delete it or make it anonymous.
Security
We use established providers, serve the whole site over HTTPS and limit who can access personal information. No website or online service is perfectly secure, so we can't guarantee security. If a breach affects your information, we will tell you when the law requires it.
International transfers
We and our providers may process information in the United States and other countries whose privacy laws may differ from yours. When information from the EU, UK or Switzerland is transferred, we rely on recognized legal safeguards, such as the European Commission's Standard Contractual Clauses or our providers' certification under the EU-U.S. Data Privacy Framework.
Your privacy rights
Everyone
Wherever you live, you can ask us to:
- tell you what personal information we hold about you and give you a copy;
- correct information that is wrong;
- delete your information;
- stop sending you marketing emails (or just click "unsubscribe").
We aim to respond within 30 days, and always within the time your local law allows. To protect your data, we may need to confirm your identity first, usually by checking the email address you used with us. We won't charge you or treat you differently for using your rights.
EU, UK and Swiss residents
Under the GDPR and similar laws, you also have the right to:
- restrict or object to how we use your information, including for direct marketing;
- receive your information in a portable format;
- withdraw consent at any time, without affecting what we did before you withdrew it;
- complain to your local data protection authority. We would appreciate the chance to fix the problem first.
California residents
- In the last 12 months we have collected the categories of information described in What we collect: identifiers (such as name, email and IP address), commercial information (memberships purchased), internet activity (site usage) and approximate location. We use them for the purposes in How we use it.
- We do not sell personal information for money. Our use of the Meta Pixel for advertising may count as "sharing" for cross-context behavioral advertising. You can opt out by contacting us, by blocking cookies or through your Meta ad preferences.
- We do not knowingly sell or share the personal information of anyone under 16, and we do not use sensitive personal information.
- You have the right to know, delete and correct your information, to opt out of sharing, and not to be discriminated against for using these rights. You can use an authorized agent to make a request. We may ask for proof that the agent acts for you.
Other U.S. states
If you live in a state with a consumer privacy law, such as Colorado, Connecticut, Texas or Virginia, you have similar rights, including the right to opt out of targeted advertising. If we turn down your request, you can appeal by replying to our decision with the word "Appeal".
How to make a request
Email us at the address in Contact us with "Privacy request" in the subject line, and tell us what you would like us to do.
Children
This site and our memberships are for adults aged 18 and over. We don't knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.
Changes to this policy
We may update this policy when our site, our tools or the law change. We will update the "Last updated" date at the top of this page. If a change is significant, we will also give notice on this site or by email.
