Agreeing to these terms

These terms of use ("terms") apply to marksfxacademy.com and to the educational content we provide through it. The site is run by MarksFX Academy, the trading education business founded by Mark Bechara ("MarksFX Academy", "we", "us").

By using this site, you agree to these terms, our Risk Disclosure and our Privacy Policy. If you don't agree, please don't use the site.

If you buy a membership or a session, the product details on Whop and Whop's own terms also apply. If they conflict with these terms on payment, billing, renewals, refunds or cancellation, Whop's terms and the product page on Whop take priority.

Education only, not advice

Everything we publish or teach is for education and general information only. That includes this website, our courses, guides and PDFs, live sessions, Zoom classes, recordings, trade ideas, community chats, Telegram alerts, emails, social media posts and 1-on-1 sessions.

None of it is financial, investment, tax, legal or trading advice. None of it is a recommendation to buy or sell anything, and none of it is tailored to your situation. We are not your financial adviser or broker.

Trading carries a substantial risk of loss. You are solely responsible for your trading decisions and their results. We do not promise or guarantee any result, including any profit, income, skill level or the passing of any prop-firm evaluation. Please read the full Risk Disclosure before you trade.

Who can use the site

You must be at least 18 years old, and able to enter a binding contract, to buy a membership or use our paid services. You are responsible for making sure that using our content, and trading the products we discuss, is legal where you live.

Memberships, billing and cancellation

Our memberships and sessions, including MarksFX Gold VIP, Small Cap & Options VIP and 1-on-1 sessions with Mark, are sold through Whop, a third-party platform.

Copy trading (MarksFX Copy) is a separate subscription. Before it is set up, you must sign the combined copy trading waiver, and the waiver's terms, including its subscription and refund policy, apply to it in addition to these terms.

• Payment. Whop processes your payment. We never receive your full card details.
• Prices. Prices are shown on this site and on Whop. The price shown on Whop at checkout is the one that applies. If we change the price of a subscription you already have, we will give you notice before the new price applies.
• Renewals. Monthly memberships renew automatically each month until you cancel.
• Cancellation. You can cancel anytime from your Whop account. Cancelling stops future renewals. Your access normally continues until the end of the billing period you have already paid for.
• Refunds. Refunds follow the refund terms shown on each product's Whop page and Whop's policies. If something isn't working for you, contact us first and we will try to help.
• Whop's terms. Your purchase is also governed by Whop's Terms of Service and Privacy Policy. We are not responsible for Whop's platform, its availability or how it processes payments.
• Changes to what's included. We regularly update our courses, tools and schedule, and we may add, change or retire parts of a membership. If a change removes something important to you, you can cancel at any time.

Using our content

Everything on this site and inside our memberships is owned by MarksFX Academy or the people who license it to us, and is protected by copyright, trademark and other laws. That includes the SMC course, the SMC & ICT student guide, the Risk Mastery PDF, the trading journal, the Gold Pre-Market Checklist, recordings, slides, text, graphics, logos and the MarksFX Academy name.

When you join a membership or download a free resource, we give you a personal, limited, non-exclusive, non-transferable license to use it for your own learning. We can withdraw that license if you break these terms. You may not:

• share your login or let anyone else use your membership;
• copy, record, download (except where we offer a download), redistribute, resell or publish our paid content;
• repost course material, recordings or trade ideas in other groups, channels or paid communities;
• use our content to build a competing course or product, or to train AI models;
• scrape, hack or interfere with the site, or try to access areas you are not allowed to access.

Short quotes with credit, for review or commentary, are fine. If you send us feedback or suggestions, we may use them without owing you anything.

Community rules

The community works because members respect each other. In the VIP chat, on Telegram, in Zoom classes and anywhere else we run, you agree not to:

• harass, threaten, abuse or discriminate against anyone;
• spam, or promote your own products, paid trading groups or referral links without our permission;
• make claims or promises about profits, income or guaranteed results;
• share other people's personal information, or post anything illegal;
• pretend to be Mark, a member of our team or another member.

We will never ask you to send us your broker login or password by chat, direct message or email, and we never hold your money. (Copy trading subscribers connect their own MT5 account themselves, directly inside the third-party copying platform, by following the setup instructions.) If someone claiming to be us asks for your login or offers to manage your money, do not respond, and report it to us.

We may remove content, and suspend or remove members who break these rules, at our discretion and as Whop's terms allow.

Trade ideas and live sessions

Trade ideas, levels and analysis shared in live sessions, chats, Telegram alerts or recordings are educational examples of Mark's method. They are not instructions. They may be wrong, they may reach you late, and they may not match the prices your broker shows. We have no duty to update a trade idea or to tell you when it no longer applies.

Live sessions currently run weekdays 8–11AM PT. Schedules can change, and sessions may be shortened, moved or cancelled. Streams, alerts and platforms can lag or fail.

Affiliate disclosure

Our member affiliate program

Members can join our affiliate program through Whop and earn a commission when someone they refer buys a membership. If you reached us through a link from a member, creator or partner, that person may earn a commission. It does not change the price you pay. Members can read more on our Partners & referrals page.

Rules for our affiliates

Affiliates must clearly disclose that they earn a commission, for example with "#ad" or "I earn a commission if you join through my link". They must follow the U.S. Federal Trade Commission's endorsement rules and each platform's rules. They must not make claims about profits, income, win rates or guaranteed results, and must not present themselves as MarksFX Academy. We may remove affiliates who break these rules and, as far as Whop's affiliate terms allow, withhold commission on referrals from misleading promotion.

Our own affiliate links

We may link to or mention third-party products, such as prop firms, brokers, charting tools or books, and we may earn a commission if you buy through our link. We will say so where it applies. A mention is not a guarantee of that product or of any outcome.

Third-party services

This site links to services we don't control, including Whop, Telegram, Zoom, TikTok, prop firms and brokers. We are not responsible for their content, policies, availability or actions. Your use of them is governed by their own terms.

Disclaimers

The site and our content are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We work to keep our content accurate and current, but markets move and information can go out of date or be wrong. We don't guarantee that the site, our live sessions or our alerts will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows:

• MarksFX Academy, Mark Bechara and our team are not liable for any trading or investment losses, lost profits, or any indirect, incidental, special, consequential or punitive damages that come from your use of the site or our content, even if we were told they were possible.
• Our total liability for any claim relating to the site, our content or these terms is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.

Some places don't allow certain limits on liability, so some of these limits may not apply to you. Nothing in these terms limits any rights you have that cannot be limited by law.

Indemnity

If a claim is made against MarksFX Academy, Mark Bechara or our team because of your trading decisions, your breach of these terms, content you post, or the way you promote us as an affiliate, you agree to cover the resulting losses and costs, including reasonable legal fees.

Changes and termination

We may update these terms. When we do, we will update the "Last updated" date at the top of this page, and if a change is significant we will also give notice on the site or by email. If you keep using the site after a change, you accept the updated terms.

We may change, suspend or stop any part of the site at any time. We may suspend or end your access if you break these terms. The sections on using our content, disclaimers, limitation of liability, indemnity and governing law continue to apply after your access ends.

Governing law and disputes

These terms are governed by the laws of the place where MarksFX Academy is established, without regard to its conflict-of-law rules, and disputes will be handled by the courts there. If you live in the EU or UK, you also keep the protection of your local consumer laws and can bring a claim in your local courts.

Before starting any formal claim, please contact us and give us 30 days to try to resolve the issue informally. Most problems can be sorted out quickly.
